Der Berliner Künstler und Bürgerrechtler Ralph Boes teilt mit, dass seine Verfassungs- beschwerde gegen die Vernichtung seines Kunstwerkes "Artikel 20 GG in Gold auf Buche" vom Bundesverfassungsgericht nicht zur Entscheidung angenommen worden ist. Damit ist die staatliche Vernichtung des Artikels 20 nicht mehr abzuwenden.
Boes spricht von einem Vorgang, der den Kern der Demokratie berührt.
"Kunst nimmt ja oft vorweg, was später in der Wirklichkeit geschieht. Denken wir nur an Orwells 1984. Wenn jetzt der Artikel 20 GG vernichtet wird, handelt es sich um ein Realbild zum Zustand unserer Republik", sagt Boes.
Der Staat tritt gegen sich selber an!
Die Stele "Artikel 20 GG in Gold auf Buche" entstand 2018/19 auf dem Rosa-Luxemburg- Platz in Berlin und wurde gemeinsam mit hunderten Bürgerinnen und Bürgern geschnitzt. Zum 70. Geburtstag des Grundgesetzes und zum 30. Jubiläum des Mauerfalls (jeweils 2019) wurde sie an der Uferpromenade am Bundestag neben dem berühmten Kunstwerk "Grundgesetz '49" von Dani Karavan aufgestellt, das die Artikel 1 bis 19 zeigt.
Artikel 1 bis 19 enthalten die sogenannten Grund- und Menschenrechte. Doch erst Artikel 20 beinhaltet die Prinzipien der Staatsstruktur. ("Die Bundesrepublik Deutschland ist ein demokratischer und sozialer Bundesstaat / Alle Staatsgewalt geht vom Volke aus ... / Die Gesetzgebung ist an die verfassungsmäßige Ordnung ... gebunden. / Gegen jeden, der es unternimmt, diese Ordnung zu beseitigen, haben alle Deutschen das Recht zum Wider- stand...")
Ausgerechnet Artikel 20, der die demokratische, rechts- und sozialstaatliche Grundordnung unserer Republik enthält, den Politikern den erlaubten Rahmen für ihr Wirken setzt, dem Volk die volle Souveränität ("Alle Staatsgewalt geht vom Volke aus") und allen Deutschen ein Recht zum Widerstand zuspricht, fehlt am Bundestag.
Boes wollte diese Lücke schließen. Der Bundestag lehnte das immer wieder ab. Nach dem Grundsatz: "Wenn die Politik sich nicht kümmert, ist es die AUFGABE DER BÜRGER, für die Wiedererrichtung des Grundgesetzes einzutreten, auch – UND GERADE ! - wenn es den Politikern nicht passt!" hat Boes den Artikel 20 am Bundestag dann ohne Genehmigung des Bundestags errichtet. Neben der Staatstruktur (Artikel 20) war so die Selbstermächtigung der Bürger gegenüber einer immer mehr grundgesetzfernen Politik mit ins Bild zu bringen.
Für den Bundestag stellt die Aufrichtung der Stele damit allerdings eine "Gefährdung der öffentlichen Ordnung" dar. Und die Stele soll jetzt als Tatwerkzeug vernichtet werden.
Kunstvernichtung in Deutschland,
die Vernichtung des Ideales unserer Republik –
(aufgestellt am Bundestag zu den Jubiläen des 70. Geburtstages des Grundgesetzes und des 30. Jahrestags des Mauerfalls)
ein wahrhaft bedeutendes Thema.

Forderung der Herausgabe der Überreste:
Die Polizei teilt mit, dass sie die Stele "ab dem 09.03.2026" vernichten wird.
Als Eigentümer der Stele hat der "Verein zur Erneuerung der Bundesrepublik an ihren eigenen Idealen e.V." bei ihr die Herausgabe der Überreste des Kunstwerks – gleich ob Holzsplitter, Fragmente oder Asche – eingefordert.
Es handelt sich bei den Überresten nicht um Müll, sondern um die ins Bild gebrachte und mit hoher Aussagekraft versehene Weitergestaltung des Kunstwerks ""Artikel 20 GG in Gold auf Buche" durch den Staat.
Die Überreste sind Bestandteil des künstlerischen Gesamtwerks und dokumentieren den Vollzug der Vernichtung seiner eigenen Ideale durch den Staat. Sie sind dafür vor- gesehen - anstelle der Stele - mit einer Dokumentation über das ganze Kunstwerk in einem Kulturhaus in Basel ausgestellt zu werden.

Boes then established Article 20 in the Bundestag without the Bundestag's approval.
