Laut BILD-Bericht soll dort eine 16-jährige Schülerin von Jugendlichen vergewaltigt und sexuell bedrängt worden sein.
Statt sofortiger Strafanzeige, Sicherheitsmaßnahmen und konsequenter Ermittlungen hat die Einrichtung dem mutmaßlichen Täter lediglich ein Hausverbot erteilt. Das zuständige Jugendamt hat zunächst nicht einmal die Polizei informiert – ein Fehler, den die zuständige Stadträtin Sarah Nagel (Linke) inzwischen selbst einräumen musste. Erst nach öffentlichem Druck durch die Medien hat die Staatsanwaltschaft die Ermittlungen aufgenommen.
Das Opfer bleibt derweil schutzlos, der Täter läuft weiter frei herum. Ein „Hausverbot“ für Vergewaltigung? Das ist keine Justiz, das ist eine Farce.
Dieser Fall steht exemplarisch für ein systemisches Problem: Bei schweren Gewaltverbrechen wie Vergewaltigung greift der Staat oft erschreckend mild durch. Viele Täter erhalten Bewährungsstrafen, ambulante Maßnahmen oder kommen mit Auflagen davon, die sie kaum spürbar belasten.
Gleichzeitig wird bei sogenannter Majestätsbeleidigung (§ 90 StGB) – also der Beleidigung des Bundespräsidenten oder staatlicher Symbole – mit voller Härte vorgegangen. Bis zu fünf Jahre Freiheitsstrafe sind hier möglich, und Behörden reagieren schnell und konsequent, sobald ein Bürger die „Würde“ von Amtsträgern oder Institutionen verbal angreift. Die Waage der Justiz kippt also klar in eine Richtung: Opferschutz und harte Strafen für reale Gewalt gegen Bürgerinnen und Bürger? Nachrangig. Schutz der staatlichen Empfindlichkeiten und schneller Durchgriff gegen Kritik? Priorität.
Es geht nicht um Einzelfälle oder Übertreibungen – es geht um eine messbare Schieflage in der Strafverfolgungspraxis. Während Vergewaltigungsopfer monatelang auf Prozesse warten und Täter oft mit minimalen Konsequenzen rechnen können, werden Beleidigungsverfahren gegen Kritiker von Politik und Behörden mitunter innerhalb weniger Wochen durchgezogen. Das ist keine ausgewogene Rechtsordnung mehr, das ist eine Prioritätensetzung, die den Schutz der Schwachen hintanstellt und stattdessen die Verteidigung von Macht und Symbolen in den Vordergrund rückt.
Es wird Zeit, dass wir diese Ungleichgewichte klar benennen und fordern: konsequente Strafen bei Sexual- und Gewaltverbrechen, lückenlose Anzeigepflicht für Jugendämter und Einrichtungen, null Toleranz gegenüber Tätern – und gleichzeitig eine ehrliche Debatte darüber, ob die Ressourcen der Justiz wirklich dort eingesetzt werden, wo sie am dringendsten gebraucht werden.
Milde bei Vergewaltigung und Härte bei Majestätsbeleidigung dürfen kein Markenzeichen deutscher Justitia bleiben. Das muss sich ändern – im Interesse der Opfer und der Glaubwürdigkeit unseres Rechtsstaats.

It's not about individual cases or exaggerations - it's about a measurable imbalance in law enforcement practice. While rape victims wait months for trials and perpetrators can often expect minimal consequences, insult proceedings against critics of politicians and authorities are sometimes carried out within a few weeks. This is no longer a balanced legal system, this is a prioritization that puts the protection of the weak aside and instead focuses on the defense of power and symbols.
It is time that we clearly name these imbalances and demand: consistent punishments for sexual and violent crimes, complete reporting requirements for youth welfare offices and institutions, zero tolerance towards perpetrators - and at the same time an honest debate about whether the resources of the justice system are really used where they are most urgently needed.
Mildness in cases of rape and harshness in cases of lese majeste should not remain a hallmark of German justice. That must change – in the interests of the victims and the credibility of our constitutional state.
