Absolute Absicherung nach 5 Jahren: Das Faktenblatt verschweigt die wichtigste Konsequenz: Sobald das Daueraufenthaltsrecht nach fünf Jahren (inkl. möglicher Arbeitslosigkeits- und Sozialhilfephasen) erreicht ist, darf die Person unbefristet Sozialhilfe beziehen, ohne dass jemals das Aufenthaltsrecht entzogen werden kann.
In den Beispielen wird ein französischer Pfleger erwähnt. Bei der Beschreibung unter welchen Bedingungen er das Daueraufenthaltsrecht erhalten würde, wird die wichtige Tatsache, dass er dieses auch erhält, wenn er 1.5 Jahre arbeitslos ist und über lange Zeit teilweise Sozialhilfe beziehen würde, einfach weggelassen.

Was fehlt / manipuliert wurde: Die Schutzklausel wird als grosser Verhandlungserfolg und «Steuerungsinstrument» verkauft. Es wird jedoch manipulierend weggelassen, wie extrem hoch die Hürden dafür sind. Die Schweiz kann die Klausel nicht einfach souverän ziehen, sondern muss das Schiedsgericht anrufen und dort beweisen, dass die «schwerwiegenden wirtschaftlichen oder sozialen Probleme» durch das FZA verursacht wurden. So hat Andreas Schwab (EU Abgeordneter und Vorsitzender der Delegation für die Beziehungen zur Schweiz und Norwegen...) bereits verlauten lassen, dass wohl erst ab einer Arbeitslosigkeit > 50% die Schutzklausel angerufen werden könnte!
Zudem wird im Faktenblatt der Begriff «Ausgleichsmassnahmen der EU» so nebensächlich eingefügt, als sei dies eine reine Formalität. Die Schweiz wird in jedem Fall mittels Ausgleichsmassnahmen bestraft!
