Unser nächster Fallbericht ist online. Das staatliche Vorgehen wird von Fall zu Fall deutlicher:

So beschreibt Prof. Dr. rer. nat. Stefan Hockertz – Toxikologe, Pharmakologe und Immunologe, ehemals Direktor und Professor am Institut für Experimentelle und Klinische Toxikologie des Universitätsklinikums Hamburg-Eppendorf – uns gegenüber sein eigenes Verfahren.
Was vorausgegangen war:
Seit März 2020 nimmt Hockertz öffentlich zu den Corona-Maßnahmen Stellung – als Wissenschaftler, der seit über drei Jahrzehnten Arzneimittel bewertet. Themen: Risiko-Nutzen-Abwägung der mRNA-Präparate, Zulassungsgrundlagen, Verhältnismäßigkeit der Maßnahmen.
Am 17. Juni 2021 durchsucht die Steuerfahndung sein Büro und seine Privatwohnung. Akten und EDV werden beschlagnahmt. Im August 2021 folgt der Vermögensarrest auf sein gesamtes deutsches Vermögen – Bankkonten, Immobilien, Lebensversicherungen – rund 1,3 Millionen Euro. Die seit 1994 bestehende deutsche Beratungsgesellschaft wird wirtschaftlich zerschlagen.
Seitdem: kein Gerichtsverfahren. Keine mündliche Hauptverhandlung. Kein Urteil. Nur ein Strafbefehl, den er nicht vor einem Richter verteidigen kann. Seit über vier Jahren.
Offiziell wird ihm Steuerhinterziehung vorgeworfen. Konkret: dass seine 2011 gegründete Schweizer Gesellschaft (TPI Consult, Stein/Aargau, mit Schweizer Geschäftsführer, ordentlich im Schweizer Handelsregister, Versteuerung auf Bundes- und Kantonsebene) keine eigenständige Betriebsstätte sei.
Genau dieselbe Konstruktion hat das deutsche Finanzamt 2017 jedoch ausdrücklich bestätigt, nach Steuergutachten und Nicht-Feststellungsbescheid. Was sich zwischen 2017 und 2021 geändert hat, ist nicht die Firmenstruktur. Es ist Hockertz' öffentliches Auftreten.
Das Verständigungsverfahren zwischen Schweiz und Deutschland 2022/23 beendete die Eidgenössische Steuerverwaltung Ende 2023 ohne Ergebnis. Hockertz lebt seit 2021 in der Schweiz und arbeitet dort weiter als Toxikologe.
Was zu einem Rechtsstaat gehört: ein Vorwurf, ein Verfahren, ein Urteil. Hier gibt es einen Vorwurf und einen Vermögensarrest über 1,3 Millionen Euro – und seit über vier Jahren keinen Termin, an dem der Beschuldigte sich verteidigen könnte.

He is officially accused of tax evasion. Specifically: that his Swiss company founded in 2011 (TPI Consult, Stein/Aargau, with a Swiss managing director, properly in the Swiss commercial register, taxed at federal and cantonal level) is not an independent permanent establishment.
However, the German tax office expressly confirmed exactly the same construction in 2017, following a tax report and non-assessment notice. What changed between 2017 and 2021 is not the company structure. It's Hockertz's public appearance.
The Federal Tax Administration ended the mutual agreement procedure between Switzerland and Germany 2022/23 at the end of 2023 without any result. Hockertz has lived in Switzerland since 2021 and continues to work there as a toxicologist.
What belongs to a constitutional state: an accusation, a trial, a verdict. There is an accusation and an arrest of assets worth 1.3 million euros - and for over four years there has been no date on which the accused could defend himself.
