Berlin, 7. April 2026 – Die Deutsche Polizeigewerkschaft (DPolG) kritisiert den
jüngsten Vorstoß von Bundesjustizministerin Hubig zur Entkriminalisierung des
Fahrens ohne gültigen Fahrschein scharf und warnt vor gravierenden rechtlichen
und praktischen Folgen.
Beim sogenannten Schwarzfahren handelt es sich um ein gemeinschädliches Betrugsdelikt nach § 265a Strafgesetzbuch und damit ausdrücklich um eine Straftat. Diese Einordnung ist aus Sicht der DPolG kein Selbstzweck, sondern zwingende Voraussetzung
für einen funktionierenden Rechts- und Kontrollrahmen im öffentlichen Personennahverkehr.
„Schwarzfahren ist kein Kavaliersdelikt, sondern eine bewusste Leistungserschleichung
zulasten der Allgemeinheit. Wer diesen Straftatbestand abschafft, hebelt ein zentrales
Steuerungsinstrument des Rechtsstaats aus“, erklärt Heiko Teggatz, stellvertretender
DPolG-Bundesvorsitzender. Gerade die Strafbarkeit ermögliche es in der Praxis, geltedes Recht überhaupt durchzusetzen. Denn nur weil Schwarzfahren eine Straftat ist, dürfen Fahrkartenkontrolleure verdächtige Personen auf Grundlage des sogenannten Jeder-
mannsrechts nach § 127 Absatz 1 Strafprozessordnung vorläufig festhalten, bis die Polizei eintrifft. Diese Befugnis gilt ausdrücklich nur bei Straftaten – nicht bei Ordnungswidrigkeiten.
Würde das Schwarzfahren entkriminalisiert, entfiele diese rechtliche Grundlage vollständig. Kontrolleure dürften Personen ohne Fahrschein künftig nicht mehr festhalten, selbst
wenn diese sich weigern, ihre Personalien anzugeben oder den Kontrollort zu verlassen.
Effektive Kontrollen wären damit faktisch nicht mehr möglich. „Wer Kontrollen rechtlichentkernt, braucht sich über Kontrollverlust nicht zu wundern. Ohne Durchsetzungsmöglichkeit verliert jede Regel ihre Verbindlichkeit“, so Teggatz weiter.
Der stellvertretende Bundesvorsitzende warnt zudem vor einem weitreichenden Dominoeffekt. Wenn Kontrollen ins Leere laufen, verlieren Fahrkarten insgesamt ihre Bedeutung.
Fahrgäste, die bislang ordnungsgemäß zahlen, würden benachteiligt, während Regelverstöße folgenlos blieben.
„Schwarzfahren ist kein „opferloses“ Delikt. Die Schäden tragen am Ende zahlende Fahr-
gäste und Kommunen. Einnahmeausfälle gefährden Investitionen in Sicherheit, Sauberkeit und Angebot des öffentlichen Nahverkehrs.
Am Ende läuft es darauf hinaus, dass der Staat den Betrieb der Deutschen Bahn AG,
ihrer Tochterunternehmen sowie der regionalen Verkehrsbetriebe vollständig aus Steuermitteln finanzieren müsste. Diese finanzpolitische Realität scheint im Bundesjustizministerium bislang keine Rolle zu spielen“, kritisiert Teggatz.
Die DPolG betont: Soziale Härtefälle erfordern gezielte sozialpolitische Lösungen wie Sozialtickets oder Unterstützungsmodelle. Eine pauschale Entkriminalisierung sei dafür jedoch der falsche Weg. Sie schwäche den Rechtsstaat, untergrabe die Arbeit von Kontrolldiensten und Polizei und belaste am Ende diejenigen, die sich gesetzestreu verhalten.
Im Jahr 2024 wurden bundesweit 140.652 Fälle der sogenannten Beförderungserschleichung gemäß § 265a Strafgesetzbuch registriert. Diese Zahl bildet jedoch nur einen Teil
der Realität ab, denn die Statistik erfasst nicht alle Sachverhalte, die landläufig unter dem
Begriff „Schwarzfahren“ verstanden werden. Fälle, in denen Fahrgäste im Bus oder in der
Bahn ein erhöhtes Beförderungsentgelt entrichten, werden in der Regel nicht angezeigt und erscheinen daher nicht in der Polizeilichen Kriminalstatistik.
