In men’s prisons, it’s common for offenders to be royghly grouped by the seriousness of their crime and the length of time they’re serving. In women’s prisons, they don’t usually do that, because it hasn’t proven necessary. 75% of female inmates are incarcerated for non-violent offenses, and the amount of violence committed even by the other 15% is significantly lower.
This means that when male murderers and rapists are transferred in from men’s facilities, they are mostly surrounded by women who are serving short sentences for non-violent offenses.
Prisoners like this are kept away from lifers and violent criminals in male facilities in an effort to reduce predation; in women’s prison, these highly vulnerable prisoners are now potential cellmates for men who were considered too manipulative and too dangerous to be allowed to live with short-term, non-violent male inmates.
In other words, many of the men who are now happily incarcerated in women’s facilities, rather than being vulnerable little flowers, are in fact some of the most dangerous men in the prison system.
Some of these men are predators whose identification as transgender is nothing but a ruse with which to get themselves transferred to a prison full of female victims, men who do not take hormones and who make no effort to present as female.
For others, their cross-dressing is at the very heart of their criminal behavior. It played a significant part in their offending: many of these men crossdress as a way to relive their crimes against women, with themselves as the stand-in for the victims.
These men are, if anything, more dangerous: paraphiliacs are more likely to have multiple fetishes than they are to have just one, and there is significant overlap between what are best described as lust murderers and male transvestites. A man who identifies as transgender is more likely than not to also have at least one other fetish; the paraphilias most likely to be comorbid with transvestism are voyeurism and exhibitionism (surprise, surprise).
Researchers have also found a significant link between gender dysphoria and sexual sadism, and multiple studies of lust murderers have found there to be an extreme overrepresentation of male transvestites in their ranks: while making up just 0.01% of the population, transvestites made up between 20% and 54% of the killers studied.
In short, these men can be extremely dangerous, and if a man is too dangerous to be allowed around vulnerable male inmates, it is absolute madness to place him in a women’s prison. It’s like locking a wolf in with the sheep to protect him from other wolves.
The fact that an incarcerated man likes to crossdress doesn’t make him vulnerable; it makes him a serious potential threat to the person of any woman unfortunate enough to be forced to be alone with him.

לפני יותר מעשרים שנה פרסם הסוציולוג קווין דיואי מאמר שבעיניי הוא מכונן – Epidemics, Panic and Power: Representations of Measles and Measles Vaccines, שבו ניתח כיצד רשויות בריאות ממסגרות מחלות מידבקות, ובאופן מעניין - במיוחד חצבת. יש במאמר הרבה תובנות מעניינות שרלוונטיות מאוד היום בדיוק כמו אז, אבל אחת המרכזיות שבהן היא שבשלב מסוים, רשויות הבריאות מתחילות למסגר את מקור הסכנה לא בווירוס עצמו, אלא באדם הנושא אותו. החולה חדל להיות אדם הזקוק להגנה, והופך למקור סיכון שיש לבודד, לשלוט בו ולהרחיקו מן הכלל.
להיפוך המסגור הזה יש חשיבות קריטית, משום שכאשר הוא מתרחש, גם המחויבויות המוסריות והאתיות כלפי החולים מתהפכות. החולה כבר איננו נתפס כמי שיש להגן עליו, אלא כמי שיש להתגונן מפניו. הוא נעשה כמעט מצורע מודרני: אדם שניתן להרחיקו מן הקהילה, להגביל את תנועתו, ואף לשלול ממנו את ההגנות הבסיסיות ביותר בשם "טובת הציבור".
לא יכולתי שלא לחשוב על המאמר הזה של דיואי כשקראתי את הכתבה הזו מ-Doctors Only ששלח לי אחד מחבריי הרופאים, על ההנחיה שפרסם השבוע משרד הבריאות לגבי חולי חצבת. לפי ההנחיה, חולה כזה לא יועבר למרחב מוגן בזמן אזעקה, מחשש להדבקה של אחרים. במילים אחרות, אדם מאושפז עלול להישאר ללא מיגון בזמן ירי טילים, לא משום שאין דרך להגן עליו, אלא משום שהוא הוגדר בראש ובראשונה כסיכון לאחרים.
הרטוריקה והמסגור הללו לא הופיעו משום מקום. בתקופת הקורונה הם עוצבו והוטמעו בצורה גלויה במיוחד. אדם שאולי נדבק לא הוגדר פשוט כחולה, או כמי שיש חשש שנדבק, אלא כ"חשוד" – מונח הלקוח מעולם הפשיעה. ממש כמו חשוד בעבירה, גם מי ש"נחשד" בכך שנדבק בווירוס הפך לאדם שיש לפקח עליו, לבודד אותו ולעיתים גם להוקיע אותו מן המרחב הציבורי.
הרופא ששלח לי את הכתבה כתב לי שההחלטה הזו מזכירה לו כיצד בתקופת הקורונה חולים מונשמים ומורדמים לעיתים נעזבו לבדם. גם אז, כמו עכשיו, הם למעשה הופקרו לגורלם, כאשר ההיגיון האפידמיולוגי דחק הצידה את החובה הרפואית הבסיסית ביותר – להישאר לצד החולה ולהגן עליו.
המסגור הזה, של החולה כ"סיכון לסביבה" לא נוצר רק כדי להתמודד עם מגיפה מסוימת. הוא עוצב מלכתחילה כדי להישאר. במאמרו על הקמפיינים של החצבת, הראה דיואי כיצד השיח סביב המחלה עוצב כך שייצר משמעת ציבורית ויאפשר לרשויות הבריאות להצדיק צעדי מדיניות כלפי האוכלוסייה. זו השפה שבאמצעותה רשויות הבריאות מדברות על מחלות מידבקות ועל בני אדם הנושאים אותן. וכאשר השפה הזו מתקבעת, היא מאפשרת להצדיק וליישם החלטות מדיניות גם ביחס למחלות אחרות.
ההנחיה הזו ממחישה עד כמה עמוק ההיפוך שעליו כתב דיואי. כשחולה מאושפז בבית חולים, המחויבות הבסיסית של המערכת היא להגן עליו. אבל ברגע שהוא מוגדר קודם כול כסיכון לאחרים, נקודת המוצא הזו מתהפכת. במקום אדם שיש להגן עליו, הוא נעשה אדם שיש להתגונן מפניו.
וזו, פשוטה כמשמעה, משמעות ההנחיה שפרסם המשרד השבוע: אדם המאושפז בבית חולים עלול להיות מופקר לחסדי הטילים האיראניים, רק משום שהוגדר כ"סיכון אפידמיולוגי". ליקוי מאורות מוסרי.
