Das mag schon sein. Nur, die Geltung der Grundrechte als Abwehrrechte des Bürgers vor einem übergriffigen Staat sind es eben gerade ganz explizit nicht.
Die Aufgabe der Judikative war nicht, den Drostens und Lauterbachs dieser Welt das Wort zu reden, sondern den Staat hart und unmissverständlich in die Schranken des Grundgesetzes zu weisen.
Eine Juristin, die das nicht verinnerlicht hat, ist als Richterin am Bundesverfassungsgericht vollkommen ungeeignet.
Die Behauptung, man müsse das Handeln „im Spiegel der Zeit“ sehen, ist eine eloquente Beschreibung des alten Narrativs: „Wir haben es nicht besser wissen können“. Es bleibt eine Ausrede ohne Lerneffekt.
Damit ließe sich im Nachhinein jedes Unrecht entschuldigen, solange nur genug Menschen mitgemacht haben.
Dass bereits damals manipulierte Statistiken, verzerrte Daten und medial geschürte Panik entlarvt worden waren, lässt Frau Brosius-Gersdorf unter den Tisch fallen. Es war nicht Unwissen – es war Ignoranz gegenüber warnenden Stimmen.
Wer in einem solchen Moment dem moralischen Gruppendruck mehr Gewicht gibt als dem verfassungsrechtlichen Gewissen, hat sich als Hüterin der Grundrechte disqualifiziert.
Verantwortung verlangt Rückgrat, nicht Rückschau-Relativierung.

Es lohnt sich, die Stellungnahme zur allgemeinen Impfpflicht von Brosius-Gersdorf und ihrem Mann vom November 2021 nochmal genauer anzusehen. Die beiden schrieben damals: "Maßnahmen wie 2G oder 2G+ oder ein teilweiser oder vollständiger Lockdown sind ebenfalls nicht ausreichend... Eine Impfpflicht ist zur nachhaltigen, anhaltenden Bewältigung der Pandemie erforderlich".
Das heißt, die - ohnehin völlig unverhältnismäßigen und nach Ansicht vieler verfassungswidrigen - 2G, 2G+ und Lockdowns gingen ihnen nicht weit genug, nein, die Impfpflicht musste her. So jemand ist für das Bundesverfassungsgericht - falls es denn Grundrechte schützen soll - völlig ungeeignet.

Zu meiner Arbeitsweise und Position im Kriegsfall am Beispiel des neuen Konfliktes im Nahen Osten:
Im Krieg wird m. E. noch mehr gelogen als während der Jagd oder bei der Liebe. Deswegen gibt es von mir keine vorschnellen Urteile wie „erfolgreicher und notwendiger Schlag gegen das Atomprogramm des Mullah-Regimes“.
Niemand weiß das bisher wirklich. Kein Trump, kein Mossad und sehr wahrscheinlich noch nicht einmal die Iraner selbst kennen wenige Tage später das ganze Ausmaß der Schäden.
Ich bin als Journalist natürlich skeptisch, wenn der Befehlsgeber wenige Minuten danach von „Erfolg“ spricht. Nicht überrascht, skeptisch. Ich kann mir keinen Journalismus ohne Skepsis ausdenken.
Und wenn „Erfolg“ dann als Tatsache in Text oder Überschrift verkauft wird, auch ohne abzuwarten welche geopolitischen Verwerfungen daraus evtl. entstehen und wenn diese Gefahr nicht einmal erwähnt wird, dann hat das mit Journalismus nichts mehr zu tun.
Nicht falsch verstehen: ich darf auch als Journalist durchaus der Meinung sein, dass das alles gerechtfertigt ist und nötig. Ich darf aber nicht den Teil der Geschichte weglassen, der meinen Jubel darüber etwas eintrüben könnte. Denn so führe ich meine Leser in die Irre.
