Das Paul-Ehrlich-Institut (PEI) gerät weiter unter Druck. Erst am 09. März 2026 hat der BGH (VI_ZR_335-24.pdf) entschieden: Hersteller müssen Impfgeschädigten nach § 84a AMG grundsätzlich Auskunft geben. Damit droht dem PEI weiteres Ungemach.
Natürlich gilt § 84a Abs. 2 AMG nicht nur für den Hersteller, sondern auch nach dem Wortlaut des Gesetztes gegenüber dem PEI, das parallel ebenfalls auskunftspflichtig ist – und zwar umfassend exakt analog im Umfang zum Hersteller.
Auch einzelne Mitglieder der Enquete - Kommission plädieren dafür, dass eine wirkliche Aufarbeitung nur möglich wird, wenn allumfassend Auskunft erteilt wird. Vor allem das BMG verweigerte sich gegenüber dem Gesundheitsausschuss diese Auskünfte zu erteilen und beruft sich auf "rechtlichen Gründe". Alle bis auf die AfD nahmen darauf dann Abstand die Daten weiterhin haben zu wollen. Auch Parlamentarier verlangen nun Auskunft von der Bundesregierung – mit einer Kleinen Anfrage zu #SafeVac vom 12. März 2026:

Die Lektüre der Anfrage lohnt, denn die dort aufgeführten Ungereimtheiten haben es in sich:
Der Verbleib von 42 % der schwerwiegenden SafeVac-Fälle ist ungeklärt. Mehr als 2 Jahre nach dem Ende der Datenerhebung bezeichnete das PEI den Meldedatenstand für SafeVac als „vorläufig“ und „Momentaufnahme“ – 15 Tage beträgt die Meldefrist für schwerwiegende Fälle. Angeblich seien aber alle schwerwiegenden Fälle fristgerecht gemeldet worden. Wie das zusammenpassen soll, bleibt erklärungsbedürftig. Auf die Antwort des PEI darf man gespannt sein.
Auch gibt es offenbar beim PEI Zahlen zur Anzahl der Nebenwirkungen (adverse events) bei SafeVac, die das PEI schon im Herbst 2024 auf einer Konferenz in Montreal vorgestellt hat. Der Journalist Barucker verlangt dazu eine weitere Presseauskunft – das PEI verweigert sie seit November 2025. Das Verwaltungsgericht Darmstadt (Az. 3 L 4630/25.DA) wird dazu in naher Zukunft entscheiden, teilte die Anwältin des Journalisten, die Kollegin Dr. Meyer-Hesselbarth @dr_fmh, mit.
Schließlich stellen sich weitere interessante Fragen, wie das BGH-Urteil vom 09. März überhaupt umgesetzt werden soll, wenn Daten offenbar nicht vorliegen, obwohl sie von Gesetzes wegen vorliegen müssten. So hat das PEI erst kürzlich in einem presserechtlichen Eilverfahren gewonnen. Die Begründung dazu ist vor dem Hintergrund des BGH-Urteils brisant: Auskunft müsse vom PEI nicht erteilt werden, weil die angefragten Daten zu Verdachtsfällen der #SafeVac-App beim PEI so nicht vorhanden sind. Eine zur Erfassung von Verdachtsfällen verpflichtete Behörde, die diese Meldungen von Amts wegen statistisch auswerten muss (Pharmakovigilanz) – und die gemeldeten SafeVac-Fälle offenbar nicht zählen kann ist deshalb dann nicht zur Auskunft verpflichtet.
Um das Bild abzurunden: Die europäische Arzneimittelagentur (EMA) hat Ende Januar 2026 entschieden, dass sie auf Verlangen des PEI die angefragten SafeVac-Daten nicht herausgibt (EMA/400045/2025, ASK 282831). Ein oberstes deutsches Zivilgericht, das die Hersteller zu umfassender Auskunft über Verdachtsfälle verpflichtet, während eine Bundesoberbehörde – sobald es um SafeVac geht – mauert, was das Zeug hält.
Die daraufhin bei der EMA eingelegte Beschwerde führt derzeit zu „ongoing consultation“ zwischen EMA und PEI. Der Ausgang bleibt abzuwarten. Eines dürfte derzeit klar sein: Die Datenfreigabe hat weder für die Hersteller noch für das PEI ein positives Nutzen-Risiko-Verhältnis.
