There is virtually no law in the Ninth Circuit. They are literally making it up as they so choose. For example, they claimed that Pfizer's C-19 licensed and unlicensed drugs are "clinically identical" but don't explain what that even means, but judicially implied that because of that fact, and whenever that fact exists, governments, hospitals, and others are no longer bound by their federal obligations relating to the investigational drug. This is legislation, not adjudication.

The question remains as to exactly what this excess in odd lab findings mortality means, as well as portends. Young-age fentanyl deaths have reduced dramatically over the last 2 years - so these are no longer fueling this dynamic.
