Every time you see someone question the No Surprises Act, I want you to consider a few things: 1. The ~4.13 million federal IDR payment determinations (completed arbitrations) under the No Surprises Act represent an extremely small fraction of total U.S. healthcare claims—roughly 0.034%, or about 1 in every 2,900 adjudicated claims—over the same period (April 2022–March 2026). 2. Multiple analyses of CMS public use files and supplemental data show that independent physicians represent a small minority of initiators and determinations. 3. In various periods (2023–early 2025), the top 4–10 initiators (e.g., Radiology Partners, TeamHealth, SCP Health, Envision, and middlemen like HaloMD) account for 45–70%+ of disputes (often 50%+ in recent quarters). Many of these are PE-affiliated hospital-based staffing or specialty groups (emergency medicine, radiology, etc.). Facilities initiate ~20% of provider-side disputes in some periods. The remaining share (after top groups) is hospital-employed physicians. Now, considering the foregoing, ask yourself why this is being framed, by certain lobbyist-adjacent “think tanks” and legacy corporate media, as a “windfall” for physicians that will drive premiums up?

At IBM Watson health I worked for a ridiculously talented and attractive female manager. At a regional meeting 3 men showed up unprepared. We had been told in advance what was expected. When they weren’t prepared, she calmly asked them questions and met their lack of response with silence. It was painfully clear that all 3 were non-performers that until that point, had effectively hidden among the folds of bureaucracy and acquisitions. Those 3 assholes then had the audacity to file a complaint with HR for a “hostile work environment” when HR called me because I was in the meeting, I let them have it. This manager had faced countless instances of sexism, misogyny, and harassment in her career, and I argued that if she was NOT a woman there is no world where these middle aged below average men would have filed a complaint. After the “investigation” HR sided with my manager, fired the 3 men, she then found a better gig. Trip down memory lane curtesy the recent JP Morgan story.

Sein Podcast ist damit nicht nur eine digitale Erfolgsgeschichte, sondern auch ein ökonomischer Beleg dafür, dass Qualität, wenn sie glaubwürdig vermittelt wird, im deutschen Medienmarkt ihren Platz findet und ausbauen kann. Ergebnisoffener Austausch ohne Filter und Eingriffe Nach eigener Aussage geht es Berndt „primär darum, zu verstehen, was ich noch nicht weiß“. Die unterschiedlichen Gäste an seinem Tisch ermöglichten ihm, den eigenen Horizont zu erweitern: „Mir ist egal, ob jemand links oder rechts steht, grün, weiß oder braun ist. Stattdessen lässt er sein Gegenüber zunächst sprechen – ohne Regie, ohne Einflüsterer, ohne korrigierende Eingriffe. Ostdeutsche Perspektiven und Herausforderungen des Westens Nachdem Unternehmer und Verleger Holger Friedrich bereits im „based.“-Podcast aufgetreten war und dort eine für die Macher überraschende Reichweite erzielt hatte, folgte nun die Einladung zu {ungeskriptet}. Für Berndt, aufgewachsen in Hagen und damit geprägt durch eine westdeutsche Perspektive, war dabei nicht die übliche Erzählung über den Osten interessant – nicht Mauer, Stasi oder Stacheldraht. Entstanden ist ein Gespräch, das weit über eine biografische Annäherung hinausgeht: eine Bestandsaufnahme der deutschen Medienlandschaft, eine Reflexion über die deutsch-deutsche Erinnerungskultur und zugleich der Blick eines emanzipierten Ostdeutschen auf die kulturellen und gesellschaftlichen Herausforderungen eines Westens, der zunehmend selbst an Gewissheiten verliert. Weniger Schablone, mehr Mensch Vor allem aber entsteht ein Bild von Holger Friedrich, das in bemerkenswertem Kontrast zu vielen bislang veröffentlichten Porträts steht – weniger Schablone, mehr Mensch. Weniger Zuschreibung, mehr Widerspruch. Und vielleicht gerade deshalb: näher an der Wirklichkeit. Ohne Sprechzettel, ohne vorherige Absprachen, ohne Netz und doppelten Boden. Komplett ungeskriptet. In der Ankündigung schreibt Ben Berndt auf Linkedin dazu: „Wenn man sich mit dem Falschen anlegt, kann das böse enden. Diese Erfahrung haben sicherlich einige von uns schon gemacht. Holger Friedrich allerdings hat es gewaltig übertrieben. Was mit einer übermütigen Provokation begann, endete damit, dass ihn die Stasi verhörte, brach und gegen seinen Willen zum inoffiziellen Mitarbeiter machte. A long story about ACA enrollment and nothing about the large numbers of improper and phantom enrollees fails to provide vital context and presents a deeply misleading and inaccurate picture of the issue. In 2025, there were 6.4 million improper ACA enrollees and probably about 4 million phantom enrollees. All well documented and researched. In Florida, there are 5x as many enrollees in 100-150 FPL coverage as eligible and in Georgia it was nearly 3x! There has been a huge number of enrollees in the last few years who used no medical care. Double the amount in a normal insurance market. No mention of GAO's enrollment of 23 of 24 ficticious applicants in fully subsidized coverage. No mention of CBO’s estimates of substantial improper enrollment in just a small set of non-Medicaid expansion states. No mention of the three DOJ convictions of massive ACA enrollment fraud schemes. No mention of the harm to people from unauthorized enrollment and enrollment switching. No context to the pre-Biden Covid subsidy boost market. No mention of the nearly 2 million people simultaneously enrolled in the ACA and Medicaid.
