Do you believe there is no political justice in Germany? Then listen to this incredible criminal justice case, which has just concluded with a (not yet final) verdict.
Michael Ballweg, a German entrepreneur who founded a protest movement against Covid measures during the pandemic, spent 280 days in pretrial detention in a solitary cell in Stuttgart-Stammheim, which was built for terrorists. There were 44 trial days. At his second hearing, he was presented to the judge in handcuffs and chained to a table like a serious criminal. He was accused of misusing donations for his organisation.
Last Thursday, he was acquitted of fraud charges. However, he was found guilty of tax evasion for incorrectly claiming VAT on a perfume and a dog mat worth 8 and 11 euros, respectively, through his company, despite these being private expenses, according to the court spokesperson.
Court documents now reveal that the initial trigger for the investigation against Ballweg was a broadcast by TV provocateur Jan Böhmermann, whose show is funded by mandatory fees paid by every German household. Research in Cooperation with the platform http://netzpolitik.org, (ironically, a news website focused on digital freedoms) prior to the broadcast had already alerted authorities. In a pseudo-investigative program aired in December 2020, Böhmermann portrayed Ballweg as a fraudster. This led to a wave of citizen complaints. Officials began forwarding these complaints—some with direct calls for investigation and marked as urgent (“eilt”)—to the Stuttgart tax office and the Karlsruhe Regional Finance Directorate, which indeed triggered an intensive review of Ballweg’s finances, despite no concrete allegations or evidence. Following the acquittal on Thursday, numerous media outlets reported in a balanced manner that Ballweg was cleared of fraud charges but convicted of tax evasion. The fact that the tax evasion involved a VAT claim of just under 20 euros was either not mentioned or only discreetly buried in the text.
Hardly any mainstream media outlet gave appropriate weight to the injustice done to Ballweg.
