Face Swap Apps machen es möglich
Heute startet HateAid gemeinsam mit Anna Nackt und dem Bundesverband Frauenberatungsstellen und Frauennotrufe Frauen gegen Gewalt e.V. eine Petition gegen die massenhafte Verbreitung von gefälschten Nacktaufnahmen und Deepfake-Pornos im Netz.
Diese lassen sich über bereits millionenfach herunter geladene Face-Swap-Apps in Sekundenschnelle erstellen.
Diese beliebten Smartphone Apps ermöglichen es, mit nur wenigen Schritten jedes beliebige Gesicht in Videoaufnahmen zu montieren. Aus einem einfachen Profilfoto wird so schnell ein kurzer Videoclip mit dem Gesicht der betreffenden Person.
Was zunächst klingt wie ein harmloser Spaß, ist in vielen Fällen jedoch keiner: Face SwapApps werden unter anderem genutzt, um Deepfake-Pornos etwa von Politikerinnen oder Schauspielerinnen zu erstellen.
Gegen ihren Willen finden sie ihre Gesichter dann in Hardcore-Pornos wieder. Studien kommen zu dem Ergebnis, dass rund 90 bis 95% aller Deepfakes nicht-einvernehmliche Pornographie betreffen, etwa 90% davon sei gegen Frauen gerichtet.
Dazu Anna-Lena von Hodenberg, Geschäftsführerin von HateAid:
„Digitale Gewalt gegen Frauen hat eine neue Dimension erreicht. Mit wenigen Klicks kann man von fast jeder Frau des öffentlichen Lebens gefälschte Nacktfotos im Netz finden, bald sogar Pornos. Die Verbreitung von gefälschten Nacktbildern und Deepfake-Pornos im Netz ist eine Form bildbasierter digitaler Gewalt. Die Betroffenen haben oftmals noch jahrelang mit den Auswirkungen zu kämpfen. Etwa dann, wenn die Aufnahmen immer wieder auf neuen Plattformen auftauchen oder dem Arbeitgeber zugespielt werden.
Mit der Verbreitung von Face Swap Apps könnte das künftig weiter zunehmen. Sie werben teils ganz offen damit, jede Person mit nur einem Foto „deepfaken“ zu können und wurden bereits mehrere Millionen Mal aus den App-Stores heruntergeladen. Manche Apps animieren sogar dazu, Nacktaufnahmen zu fälschen, wie erst vor wenigen Wochen eine umfangreiche Recherche von Spiegel und Netzpolitik .org aufzeigte.
Die derzeitige Rechtslage spiegelt diese Entwicklungen jedoch kaum wider: Sie behandelt die Verbreitung von Nacktaufnahmen im Internet noch immer als Bagatelldelikt.
Das Bündnis fordert daher von Bundesdigitalminister Wissing:
Ungewollte Manipulation von Nacktaufnahmen stoppen! Nutzen Sie Ihre Möglichkeiten und verhindern Sie, dass App-Anbieter ungewollte Manipulation von Nacktaufnahmen anbieten und anpreisen. Es sollte Anbietern derartiger Apps und sonstiger Dienste untersagt werden, die Erstellung von gefälschten Nacktfotos und pornographischen Videos zu ermöglichen.
Manipulations-Apps raus aus den App-Stores! Setzen Sie sich dafür ein, dass App Stores keine Apps mehr anbieten, die die ungewollte Manipulation von Nacktbildern ermöglichen. Die Stores sollten in die Pflicht genommen werden, derartige Angebote zu sperren.
Mit starken Gesetzen die ungewollte Manipulation stoppen! Wir brauchen nicht zwingend neue Straftatbestände, aber die geltenden Gesetze müssen dringend angepasst werden. Denn in den meisten Fällen handelt es sich bei der Verbreitung gefälschter Nacktaufnahmen um Beleidigung, Verleumdung oder Verletzung des Rechts am eigenen Bild.
Diese Delikte werden als minder schwere Straftaten nur unzureichend verfolgt und zu oft auf den Privatklageweg verwiesen. Doch wenn sie öffentlich im Netz begangen werden, sind sie keine Privatsache. Wir fordern daher, sie in diesen Fällen als relative Antragsdelikte auszugestalten, um sie allein aufgrund des öffentlichen Interesses verfolgen zu können.
Die Petition läuft bis zum 24. Januar 2023 und wird anschließend an Bundesdigitalminister Volker Wissing übergeben.

The distribution of fake nude images and deepfake porn in the network is a form of image-based digital violence. The affected people often have to fight with the effects for years. For example, when the recordings are recurring on new platforms or being played to the employer.
With the spread of Face Swap apps, this could continue to increase. They sometimes openly advertise each person with only one photo “deepfaken” and have been downloaded several million times from the app stores. Some apps even animate to falsify nude shots, as only a few weeks ago a comprehensive search of mirrors and network policy .org showed.
However, the current legal situation hardly reflects these developments: it still treats the spread of nude recordings on the Internet as a bagatel publication.
The alliance therefore demands from Federal Digital Minister Wissing:
Unintentional manipulation of nude shots stop! Take advantage of your options and prevent app providers from offering and awarding unwanted manipulation of nude recordings. Providers of such apps and other services should be prohibited from creating fake nude photos and pornographic videos.

Meine Schwägerin ist ja HNO-Fachärztin und wir haben uns neulich erst über ihre Praxis unterhalten. Was ich den Hammer fand, war, dass 13 bis 15 Prozent ihrer Termine von der Kasse gar nicht bezahlt werden! Sie arbeitet also über ihr Budget hinaus weil sie die Patienten ja nicht einfach wegschicken kann. Hochgerechnet auf ganz Deutschland sind das über 40 Millionen Facharzttermine pro Jahr – unbezahlt!
Jetzt plant die Regierung ein Sparpaket weil das Defizit in die zweistelligen Milliarden geht. Die Kassenärzte sagen dementsprechend ganz zu Recht: Wenn ihr bei uns kürzt, fallen diese Termine einfach mal weg.
Nur mal so zur Einordnung: Die ambulante Versorgung macht 16 Prozent der Kosten aus, stemmt aber 97 Prozent der Versorgung. Das große Geld ist da ja nicht mal ansatzweise zu holen. Gleichzeitig gehen 60 Milliarden pro Jahr für versicherungsfremde Leistungen drauf, also Sachen die mit Krankenversicherung nichts zu tun haben. Aber da traut sich wie üblich keiner ran.
